About these terms
These Terms of Service (“Terms”) are a legal agreement between you and Scovel Investments 719, LLC, a Texas limited liability company doing business as Tenere Technology (“Bramble,” “we,” “us”), governing your use of the Bramble website at watchbramble.com and the Bramble app for your streaming device (together, the “Service”). Please read them carefully. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Your privacy is governed by our Privacy Policy and Children’s Privacy Notice; your subscription is also governed by our Auto-Renewal Terms, which are incorporated into these Terms.
Who may use Bramble
You must be at least 18 years old and the parent or legal guardian of any child who will watch through the Service, and you must have the legal capacity to enter into these Terms. You are responsible for setting up and curating the Service and for your child’s use of the device, which Bramble intends to take place with your direct and continuing involvement. The account, the subscription, and this agreement are yours.
What Bramble does — and does not do
Bramble lets you build a curated list of approved children’s shows and display it on your television as a simple grid; selecting a show opens the relevant third-party streaming app at that title. Bramble does not host, stream, provide, or control any video content, and it does not include any subscription to any streaming service. To watch anything, you need the relevant third-party app and any subscription it requires, which are governed by that provider’s own terms and prices. Bramble simply holds your list and knows how to open other companies’ apps.
Your account
You sign in with a one-time code sent to your email, or with Google sign-in; there is no Bramble password. Keep whichever you use — your email account or your Google account — secure, and tell us promptly at support@watchbramble.com if you believe your account has been accessed without your permission. You are responsible for activity under your account. The information you provide must be accurate.
Subscriptions, billing, and cancellation
Bramble is a paid subscription. Pricing, the free trial, automatic renewal, billing, renewal and price-change notices, and how to cancel are described in the Auto-Renewal Terms, which you should read and which form part of these Terms. In short: your subscription renews automatically until you cancel, you can cancel at any time, and you consent to the renewal terms separately at checkout.
Acceptable use
Please use the Service only for its intended personal, family purpose. You agree not to: use the Service for any unlawful purpose; interfere with or disrupt the Service or its security; attempt to access accounts, data, or systems that are not yours; reverse engineer, scrape, or copy the Service except as the law permits; resell or commercially exploit the Service; or misuse the deep-link functionality to circumvent any third-party provider’s terms.
Intellectual property
The Service — including the Bramble software, website, name, and branding — is owned by us and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while your account is in good standing. Show titles, artwork, logos, and other materials relating to third-party programs are the property of their respective owners; Bramble claims no rights in them and displays them only to help you identify and open the shows you have chosen.
Third-party apps, deep links, and things outside our control
The Service depends on third-party streaming apps and services that we do not own or control. We do not guarantee that any third-party app will be available, that a deep link will open a given title, or that a show will remain offered by any provider. Streaming services routinely change, rename, remove, or restructure their apps and content, and when they do, a Bramble tile or link may stop working — through no fault of Bramble and outside our control. Your access to any content is subject to the third party’s own terms, availability, and pricing.
Force majeure. We are not responsible for any failure or delay caused by events beyond our reasonable control, including changes to or outages of third-party apps, app stores, streaming services, networks, or infrastructure providers.
Disclaimers — “as is,” and no service-level guarantee
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that it will work with every device, network, or third-party app.
No service-level commitment. Bramble is a low-cost consumer service and does not offer a service-level agreement or uptime guarantee. This is a deliberate choice, not an oversight: we do not promise any particular level of availability, and we may perform maintenance, modify, or suspend features at any time.
Limitation of liability
To the fullest extent permitted by law:
(a) Bramble and its owners, officers, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Service, even if we have been advised of the possibility of such damages.
(b) Bramble’s total liability for any and all claims arising out of or relating to the Service or these Terms will not exceed the greater of (i) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (ii) twenty U.S. dollars ($20).
(c) Nothing in these Terms limits or excludes any liability, or waives any right or remedy, that cannot be limited, excluded, or waived under applicable law — including liability for fraud or fraudulent misrepresentation, willful injury, or gross negligence, and any non-waivable rights or remedies you have under consumer-protection or automatic-renewal law. This subsection controls over anything else in these Terms.
Indemnification
You agree to indemnify and hold Bramble harmless from claims and expenses arising out of your misuse of the Service or your violation of these Terms or of any third party’s rights. This does not apply to the extent a claim arises from our own fraud, willful misconduct, or gross negligence, or is otherwise non-waivable under applicable law.
Changes to the Service and to these Terms
We may modify the Service or these Terms. If we make a material change to these Terms, we will post the updated Terms with a new effective date and notify you by email. For any change to your subscription pricing, we will give you advance notice as described in the Auto-Renewal Terms. Your continued use after a change takes effect means you accept the updated Terms; if you do not agree, stop using the Service and cancel.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or if we are required to by law or by a platform provider. Sections that by their nature should survive termination (including Sections 6, 8, 9, 10, 13, and 14) will survive.
Severability and no waiver
If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it.
Governing law and where disputes are heard
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and the exclusive venue for any dispute is the state and federal courts located in Travis County, Texas — except that nothing in these Terms deprives you of, or requires you to waive, any mandatory consumer-protection right or protection you are entitled to under the law of your home state. For example, if your home state gives you mandatory consumer-protection rights that cannot be waived by contract, those rights continue to apply to you regardless of the choice of Texas law above.
Dispute resolution — informal resolution first
Please contact us first. Before filing any formal claim, email us at support@watchbramble.com with a description of the issue, and we will try in good faith to resolve it. Most concerns can be handled quickly this way.
